A: Yes, a number of TKCo licensees are aware of TGPC's broad rights in certain Thomas Kinkade images, including our rights to license these images and derivations therefrom into all product categories and geographical territories.


A: Yes. With the unlimited variables of composition, image size and color shadings, assuming sufficient volume, we can provide unique products to your organization or even license a particular image to you for specificed purposes and periods of time. A poster, card, calendar or other format that includes custom text selected by your organization is available.


A: A majority interest in TGPC is owned by Mr. and Mrs. George Goff. Any remaining interest(s) is owned by such person(s) and/or entities as the Goffs may, from time to time, transfer a minority interest to.


A: A written contract (the Agreement) was entered into in September 2001 between the Goffs, the Kinkades and Media Arts Group, Inc., predecessor in interest to The Thomas Kinkade Company (TKCO), whereby, among other things, the Goffs acquired complete rights to the Thomas Kinkade images offered for licensing and/or sale by TGPC.








A: Until 80 years after the death of Thomas Kinkade.


A: TGPC is aware that there appear to be inconsistencies between the Goffs' adjudicated exclusive rights in Thomas Kinkade artwork and the rights TKCO appears to have licensed to certain third parties. TGPC is also aware that TKCO has stated that it does not grant exclusive licenses to its licensees. Concerns along these lines by third party TKCO licensees should be discussed with their counsel and/or directly with TKCO.



A: Yes. TGPC will evaluate proposals from current TKCO licensees using the same criteria it uses to evaluate proposals from any other company.



A: Yes. In an arbitration conducted in July 2007 TKCO sued the Goffs, challenging the Goffs rights under the Agreement regarding the Thomas Kinkade artwork to which the Goffs hold exclusive rights, the sub-licensing of that artwork, the creation of derivative works from that artwork, the creation of whatsoever products from that artwork and related matters. The arbitrator issued a final Decision on August 14, 2007. Specifically, the Goffs have the right to sub-license their Thomas Kinkade artwork into all product categories and geographical territories, to create derivative images therefrom and to create whatsoever products from their artwork as they may determine. The Goffs are entitled to use the name Thomas Kinkade in various ways in their sales and marketing activities. Licensees of TGPC have nominative fair use of the name 'Thomas Kinkade' and, in addition, TGPC can, on behalf of its licensees, request TKCO to approve any reasonable use of Thomas Kinkade's name in association with licensees' marketing programs and, according to the arbitrator, TKCO's approval shall not be "unreasonably withheld".



A: The "Robert Girrard Collection" consists of 73 works (71 oil paintings and 2 pencil sketches) created by Thomas Kinkade during the years 1984 to 1990. Eighty-five percent of these paintings are studio works. Many of Kinkade's Girrard signed works are considered by knowledgeable experts, including Thomas Kinkade, to be among the best works of Kinkade's career. There is no person named “Robert Girrard” who is associated with Thomas Kinkade and/or his artwork. "Girrard" is simply a brush name used by Thomas Kinkade to sign the original paintings and drawings in the "Girrard Collection".





A: Yes. TGPC will fully cooperate with legitimate prospective licensees to insure that they and their counsel receive all relevant information pertinent to their decision to become a TGPC licensee. TGPC is committed to full disclosure and open and candid communications, both of which are in the best interests of TGPC and all of its licensees and prospective licensees.
